Terms of Service

1. Eligibility

You must be at least 17 years old to use DreamCatcher. The app is rated 17+ because it supports user-generated dream content, which can include mature, surreal, or disturbing themes. By using the Service you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Your Account

You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately at ian@thedreamcatcher.ai if you suspect unauthorized access.

3. Your Content

DreamCatcher lets you submit text, audio recordings, AI-generated images, and related metadata (collectively, "User Content"). You retain full ownership of your User Content. You grant us a limited, worldwide, non-exclusive, royalty-free license to store, process, display, and transmit your User Content solely to operate and improve the Service (including automated moderation, transcription, and AI generation you initiate).

You can delete any dream, stop sharing any dream with any circle, or delete your entire account at any time. Deletion is irreversible and takes effect within 30 days across all backups.

4. Acceptable Use

You agree not to, and not to help anyone else:

• Submit content that is unlawful, harmful, abusive, harassing, defamatory, obscene, hateful, incites violence, depicts or solicits sexual content involving minors, or violates anyone's intellectual-property or privacy rights.
• Impersonate another person or misrepresent your affiliation with any person or entity.
• Interfere with, overload, or attempt to circumvent the Service's security, rate limits, or moderation controls.
• Reverse-engineer, decompile, or create derivative works from any component of the Service except as permitted by applicable law.
• Use automated means to create accounts, submit content, or scrape data.
• Use the Service to transmit malware or to send unsolicited commercial messages to other users.

We reserve the right to remove any content that violates these rules and to suspend or terminate accounts that engage in the prohibited conduct above, with or without notice depending on the severity.

5. Moderation, Block, and Report

All dream submissions pass through an automated moderation step. Content flagged as clearly policy-violating is blocked from being saved. Content flagged as borderline is forced to private visibility even if you requested wider sharing.

You can block another user at any time from the dream detail screen; blocking hides their dreams from you and yours from them. You can report any dream or user for moderator review; we respond to reports within 24 hours.

We have no obligation to review, edit, or remove User Content, but we reserve the right to do so at our discretion. We are not liable for User Content posted by other users.

6. AI-Generated Content

When you invoke our AI features, your dream text is sent to our AI provider for processing. Outputs (images, interpretations, titles) are returned to you and stored with your dream.

AI outputs are for personal reflection and entertainment only. They are not medical, psychological, legal, or clinical advice. Do not rely on them for important decisions.

You are responsible for the dream text you submit. Don't submit text that violates your country's laws, and don't use the AI features to produce content that violates the Acceptable Use rules above.

7. Purchases and Subscriptions

The Service is currently offered free of charge. If we introduce paid features in the future, purchases on iOS will be processed by Apple via the App Store and purchases on Android will be processed by Google Play, each subject to the applicable store terms, including Apple's standard payment terms and Google Play's standard payment terms . Refund requests for app-store purchases must be directed to the relevant store; we cannot process them directly.

8. Apple App Store — Additional Terms

This section supplements the Terms and applies only to the iOS app.

• Licensor: The app is licensed, not sold, to you. Your license is a non-exclusive, non-transferable right to use the app on any Apple-branded products you own or control.
• Apple as third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right (and will be deemed to have accepted the right) to enforce these Terms against you.
• Maintenance and support: Project Win LLC is solely responsible for providing any maintenance and support with respect to the app. Apple has no obligation whatsoever to furnish any maintenance or support.
• Warranty: In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
• Product claims: Project Win LLC, not Apple, is responsible for addressing any claims relating to the app, including product liability, non-conformity with legal requirements, or consumer protection claims.
• Intellectual-property claims: In the event a third party claims the app infringes its intellectual-property rights, Project Win LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Legal compliance: You represent that you are not located in a country subject to a U.S. government embargo and are not listed on any U.S. government list of prohibited or restricted parties.

9. Termination

You may stop using the Service at any time by deleting your account in Settings. We may suspend or terminate your access if you violate these Terms, with or without notice depending on severity. Sections that by their nature should survive termination (ownership, disclaimers, limitations of liability, arbitration) will survive.

10. Service Availability

We aim for reliability but do not guarantee that the Service will be uninterrupted, secure, or error-free. We may modify, suspend, or discontinue features at any time.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that any AI-generated output is accurate, complete, or fit for any purpose.

12. Limitation of Liability

To the maximum extent permitted by law, in no event will Project Win LLC or its officers, directors, employees, or affiliates be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed one hundred U.S. dollars (USD $100).

13. Indemnification

You agree to indemnify and hold harmless Project Win LLC and its affiliates from any claim, demand, or damages arising out of your User Content, your use of the Service, or your violation of these Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Jefferson County, Colorado, and you consent to personal jurisdiction there.

Class-action waiver: To the extent permitted by law, you and we agree that any claim will be brought in individual capacity only, not as a plaintiff or class member in any purported class or representative proceeding.

15. Changes to These Terms

We may update these Terms from time to time. For material changes we will post a notice in-app or by email before the change takes effect. Continued use of the Service after an update means you accept the revised Terms.
